When you place an order, you are making an offer to purchase. OwnWatts reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until OwnWatts confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as OwnWatts may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

OwnWatts is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with OwnWatts. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and OwnWatts, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with OwnWatts.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL OwnWatts, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 17 - NOT AN INSTALLER; NO INSTALLATION SERVICES PROVIDED

OwnWatts (Sustainability Support LLC) is a retailer and cooperative purchasing facilitator of plug-in solar equipment. We are not a licensed electrician, contractor, or installation company, and we do not provide installation services. Any installation-related information, guidance, buying guides, kit configurations, or similar content provided on or through the Services is offered for general educational purposes only and does not constitute installation instructions, engineering advice, or a representation that installation by you, a friend, family member, volunteer, or any unlicensed individual is safe, code-compliant, or appropriate for your specific circumstances.

You are solely responsible for determining who installs any product purchased through OwnWatts and for ensuring that installation is performed safely and in compliance with all applicable electrical codes, manufacturer instructions, and local, state, and utility requirements. We strongly recommend that installation, or at minimum a final safety inspection and connection, be performed or verified by a licensed electrician.

OwnWatts is not responsible or liable for any injury, death, property damage, fire, equipment damage, or other loss arising from or related to the installation of any product purchased through the Services, regardless of who performs the installation, including installation assisted, supervised, or performed by OwnWatts personnel, contractors, or volunteers acting in connection with any cooperative, pilot, or community program, except to the extent such loss is caused by our gross negligence or willful misconduct.

It is solely the customer's responsibility to determine and comply with all laws, regulations, utility requirements, and any other rules applicable to the purchase, ownership, and use of any product purchased through the Services in their specific location. This includes, without limitation, obtaining any required permits, approvals, or authorization from the utility company, homeowners' association, landlord, or local building authority before installing or operating any plug-in solar product.

Any regulatory or legislative information provided by OwnWatts, including our state-by-state legislation tracker and related content, is offered as general educational information only, reflects our understanding of publicly available sources as of the date published, and is not a substitute for independent verification with your utility, local authority, or legal counsel. OwnWatts is not responsible or liable for any fines, penalties, disconnection, legal action, or other consequences arising from the failure to obtain required permission or comply with applicable laws or utility requirements, whether or not you relied on information provided through the Services.

SECTION 20 - PRODUCT USE AND ASSUMPTION OF RISK

By purchasing and using any product through the Services, you acknowledge that plug-in solar equipment involves inherent risks, including but not limited to electrical shock, fire, and property damage, particularly if installed, modified, or used improperly, or used with incompatible equipment. You assume all risks associated with the purchase, installation, and use of any product obtained through the Services, except to the extent such risk results directly from a manufacturing defect covered under the applicable manufacturer's warranty or our Products/Completed Operations insurance coverage.

You agree to: (a) follow all manufacturer instructions and warnings; (b) use only manufacturer-approved or compatible components; (c) not modify, bypass, or disable any safety, anti-islanding, or overcurrent protection features; and (d) discontinue use and contact us immediately if you observe any damage, malfunction, or unsafe condition.

SECTION 21 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless OwnWatts, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.
